1. Definitions

1.1 “The Company” refers to Indigo-GT Performance Ltd T/A Indigo-GT Automotive, company registration number 10758000.

1.2 “The Buyer” refers to the person, partnership, limited company, or other legal entity, who agrees to products being provided by Indigo-GT Performance Ltd.

1.3 “The Conditions” refers to the terms and conditions of Indigo-GT Performance Ltd’s operations, set out in this document and any special terms and conditions agreed in writing by a Director, Company Secretary, or other member of this company’s management team, acting for and on behalf of Indigo-GT Performance Ltd.


2. Conditions

2.1 These Conditions shall apply to all contracts for any products provided by the Company to the Buyer, to the exclusion of all other terms and conditions, including any terms and conditions the Buyer may purport to apply under any purchase order, confirmation of order, or similar document.

2.2 Ordering of any products by the Buyer from the Company shall be deemed conclusive evidence of the Buyer’s acceptance of these Terms & Conditions.


3. Prices

3.1 Prices do not include Shipping or Installation fees unless otherwise stated in the product description.

3.2 The Company reserves the right to alter the specifications and prices of its products without notice. 


4. VAT

4.1 VAT is charged at the current rate of 20% to customers within the United Kingdom, for orders where the billing and shipping address are located outside of the United Kingdom, VAT is automatically removed during checkout. 


5. Payment

5.1 The Company accepts payment by Visa, MasterCard & American Express.

5.2 The Company accepts payment from overseas customers using international bank transfer, the Buyer is responsible for covering all relevant transaction fee's.

5.3 The Company offers finance products to eligible Buyers subject to acceptance within the United Kingdom from Klarna Bank AB and Payment Assist Ltd, in addition to Company's terms and conditions, the Buyer's will be required to accept the terms and conditions of the chosen lender.

5.3 The Company does not accept PayPal or Cheques.

5.4 The Company shall not dispatch goods or place goods on back order until payment is received in full or, where the Buyer has chosen to finance their order, their application has been completed, accepted and verified by the lender.

5.7 In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer you the following payment options, payment is to be made to Klarna;

  • Financing

6. The Company's Right of Cancellation

6.1 If for reasons beyond the Company's reasonable control, including but not limited to an inability or failure on part of the manufacturer or supplier of the goods to supply the goods to the Company, or any other reason the Company is unable to supply the goods to the buyer, the Company may cancel the agreement at any time before the goods are delivered by giving notice to the Buyer. 

6.2 In the eventuality of a cancellation by the Company, the Buyer shall be refunded any sums paid by them or on their behalf under or in relation to the agreement. 

6.3 The Company shall not be liable for any other loss or damage arising from such cancellation.


7. Dispatch, Delivery & Shortfalls 

7.1 The Company uses TNT, DPD Local, UPS and occasionally Royal Mail to dispatch goods to the Buyer, international exceptions apply where local courier companies may be contracted.

7.2 In the unlikely event that orders are delivered incomplete or damaged, the responsibility falls upon the Buyer to ensure that such shortfalls/damage are correctly noted by the courier, if in doubt, the delivery should be rejected.

7.3 Successful delivery confirmation serves as notification that the consignment is complete and has been delivered to the Buyer in good condition, the Company cannot accept claims for damaged goods or delivery shortfalls where the consignment has been accepted by the Buyer without notification of an issue with the delivery. 


8. Stock

8.1 This website does not display any information regarding a products stock level, to determine the availability of a product, the Buyer must contact the Company with the product specific SKU.

8.2 If the Buyer needs an order by a certain day/date, we strongly recommend the Buyer contacts a member of our sales team to check the availability of the item(s) you require prior to ordering.

8.3 Where the Buyer is planning to have their items fitted professionally, we strongly advise the Buyer waits until the order has been received and checked before making any workshop or garage appointments.


9. Overseas Customers

9.1 The Company is able to export most of its product range, where Buyers are situated outside the United Kingdom, (Far East, Africa, Asia, North/South America & Oceania), UK VAT is not payable.

9.2 Following the United Kingdom's withdrawal from the European Union, buyers in the EC will no longer be charged VAT by the Company but will be responsible for local import fee's including Duty & VAT. 

9.3 Due to specific restrictions, there are some countries that we can only accept bank transfer payments from.

9.4 Orders returned from Non-UK customers are subject to a 30% restocking fee, the cost of which shall be deducted from any refunds that the buyer may be entitled to.


10. Returns Procedure

10.1 Before returning any goods please read all our terms and conditions, the Company must be informed by e-mail or telephone of any items that the Buyer wishes to return for credit, refund or exchange within 14 days commencing the day of delivery.

10.2 The Buyer must ensure that they include a copy of their invoice when shipping any items back to the Company.

10.3 The Company will not pay the cost for shipping of any returned goods.

10.4 All products being returned must be in a resalable condition, complete and include all the original packaging, returns will not be accepted where products appear to have been fitted or in anyway modified. 


11. Special Order Items

11.1 Orders for products either marked as 'special order items' or where the Buyer has been informed by the Company that the product is a 'special order item' may not be cancelled by the Buyer once the order has been confirmed by the Company unless the agreed upon lead time is exceeded by an unreasonable period of time.

11.2 Products specially ordered to the Buyer's requirements cannot be returned unless the goods are not of satisfactory quality, not fit for purpose or not as originally described.


12. Limitations Upon Liability

12.1 The Company’s services and all information, content, materials, products (including software) and other services included on or otherwise made available to you through the Company’s services are provided by the Company on an "as is" and "as available" basis.

12.2 To the full extent permissible by the laws of England and Wales, the Company disclaims all liability from consequential, incidental, punitive, or indirect damages arising from or relating to any advice or information provided to the Buyer by the Company.

12.3 The Company provides products and/or services to the Buyer based on the understanding that such products and/or services shall be fitted, used and operated by sufficiently qualified and/or competent persons, as such to the full extent permissible by the laws of England and Wales, the Company disclaims all liability from consequential, incidental, punitive, or indirect damages arising from or relating to the use of the Company’s products and/or services.

12.4 Unless otherwise specified in writing, the Company makes no representations or warranties of any kind, express or implied, as to the operation of the services, or the information, content, materials, products (including software) or other services included on or otherwise made available to you through the Company.

12.5 Unless otherwise specified in writing, you expressly agree that your use of the Company’s products and/or services is at your sole risk.

12.6 To the full extent permissible by the laws of England and Wales, the Company disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. 

12.7 The Company does not warrant that the Company’s services, information, content, materials, products (including software) or other services included on or otherwise made available to you through the Company’s services, servers or electronic communications sent from the Company are free of viruses or other harmful components.

12.8 To the full extent permissible by the laws of England and Wales, the Company will not be liable for any damages of any kind arising from the use of any service, or from any information, content, materials, products (including software) or other services included on or otherwise made available to you through the Company, including, but not limited to direct, indirect, incidental, punitive, and consequential damages, unless otherwise specified in writing.


Further Terms and Conditions

1. Any products which have been amended or modified from their original specification will not be credited under any circumstance. Any amendments or modifications carried out in an effort to install items are done so purely at the Buyer's risk.

2. All products intended to be painted must be trial fitted to vehicle prior to painting.

3. Where applicable, the Company reserve the right to refuse exchange units, which are considered to be in an un-serviceable condition. 

4. Surcharges must be paid upon purchase of any reconditioned/rebuilt items and will be reimbursed only if and when the supplier or manufacturer accepts the surcharge unit. 

5. All goods remain the property of Indigo-GT Performance Ltd until paid for and payment received in full. 

6. The Company accepts no claim for labour under any circumstances. 

7. Any product or labour warranty offered is non-transferable.

8. The vast majority of manufacturers items must be returned for inspection prior to any warranty repair or replacement being agreed.

9. No warranty will be considered unless the Buyer can produce a genuine invoice in their name.
